Terms and Conditions of Use
OVERVIEW
This website is operated by Moline Housing Authority. Throughout the site, the terms “we”, “us”, and “our” refer to Moline Housing Authority. Moline Housing Authority offers this website, including all information, tools, forms, and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies, and notices stated here.
By visiting our site, accessing resident resources, submitting inquiries, or communicating with us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms apply to all users of the site, including without limitation users who are browsers, applicants, residents, vendors, contractors, and contributors of content.
Please read these Terms of Service carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services.
You can review the most current version of the Terms of Service at any time on this page. We reserve the right to update, change, or replace any part of these Terms of Service by posting updates and/or changes to our website. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.
SECTION 1 – GENERAL CONDITIONS
We reserve the right to refuse service to anyone in accordance with applicable federal, state, and local housing regulations and laws.
You understand that your content (not including sensitive payment or personal identity documents), may be transferred unencrypted and involve transmissions over various networks and changes to conform and adapt to technical requirements of connecting networks or devices. Sensitive information submitted through designated secure forms is encrypted during transfer over networks.
You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the service is provided, without express written permission by us.
The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.
SECTION 2 – ACCURACY, COMPLETENESS AND TIMELINESS OF INFORMATION
We strive to ensure that all information on this site is accurate and up to date. However, we are not responsible if information made available on this site is not complete, current, or entirely free of typographical errors. The material on this site is provided for general informational and civic guidance only and should not be relied upon as the sole basis for making legal, financial, or housing decisions without consulting official Moline Housing Authority staff or official program documents.
This site may contain certain historical information, such as archived board meeting minutes, prior notices, or past financial reports. Historical information, necessarily, is not current and is provided for reference only. We reserve the right to modify the contents of this site at any time, but we have no obligation to update any information on our site. You agree that it is your responsibility to monitor changes to our site.
SECTION 3 – MODIFICATIONS TO SERVICES AND PROGRAMS
Housing programs, policies, procedures, and service availability are subject to change in accordance with U.S. Department of Housing and Urban Development (HUD) guidelines and local authority policies.
We reserve the right at any time to modify or discontinue any program, service, feature, or content without notice. We shall not be liable to you or to any third party for any modification, suspension, or discontinuance of website features or informational services.
SECTION 4 – HOUSING SERVICES AND ONLINE RESOURCES
Certain resources, applications, portals, or services may be available exclusively online through the website. We reserve the right to limit the availability of our services or programs to any person, geographic area, or jurisdiction consistent with program eligibility guidelines and applicable fair housing laws.
All descriptions of housing programs, eligibility thresholds, and resident resources are subject to change at any time without notice at our sole discretion. Any offer or informational summary of a program or service made on this site is void where prohibited by law.
SECTION 5 – OPTIONAL THIRD-PARTY TOOLS
We may provide you with access to third-party tools, portals, or external resources (such as resident portals, maintenance ticketing platforms, or communication tools) over which we neither monitor nor have direct operational control.
You acknowledge and agree that we provide access to such tools ”as is” and “as available” without any warranties, representations, or conditions of any kind. Moline Housing Authority shall have no liability whatsoever arising from or relating to your use of optional third-party tools.
Any use by you of optional tools offered through the site is entirely at your own risk and discretion, and you should ensure that you are familiar with and approve of the terms on which tools are provided by the relevant third-party provider(s).
SECTION 6 – THIRD-PARTY LINKS
Certain content, resources, and services available via our Service may include materials or links from third parties, such as community assistance organizations, municipal services, or federal agencies.
Third-party links on this site may direct you to websites that are not affiliated with Moline Housing Authority. We are not responsible for examining or evaluating the content or accuracy, and we do not warrant and will not have any liability or responsibility for any third-party materials, websites, or external services.
Please review carefully the third party’s policies and practices before engaging in any transaction or sharing personal information. Complaints, claims, concerns, or questions regarding third-party resources should be directed to the third party.
SECTION 7 – USER SUBMISSIONS AND FEEDBACK
If you send certain submissions, inquiries, suggestions, proposals, or other materials, whether online through our web forms, by email, by postal mail, or otherwise (collectively, ‘comments’), you agree that we may, at any time, without restriction, use, review, and evaluate such information to administer services, address feedback, and improve operations.
You agree that your submissions will not violate any right of any third party, including copyright, trademark, privacy, or other personal or proprietary right. You further agree that your comments will not contain libelous, abusive, threatening, or otherwise unlawful material, or contain any computer virus or malware that could affect website operations. You may not use a false email address, pretend to be someone other than yourself, or otherwise mislead us as to the origin of any submission.
SECTION 8 – PERSONAL INFORMATION
Your submission of personal information through our website forms and communication channels is governed by our Privacy Policy. Please review our Privacy Policy to understand our practices regarding data collection, protection, and mobile subscriber non-sharing guarantees.
SECTION 9 – ERRORS, INACCURACIES AND OMISSIONS
Occasionally there may be information on our site or within our communications that contains typographical errors, inaccuracies, or omissions relating to office hours, program descriptions, meeting notices, or application instructions. We reserve the right to correct any errors, inaccuracies, or omissions, and to change or update information at any time without prior notice.
We undertake no obligation to update, amend, or clarify information on our site or related services, except as required by law or HUD guidelines.
SECTION 10 – PROHIBITED USES
In addition to other prohibitions set forth in the Terms of Service, you are prohibited from using the site or its content: (a) for any unlawful purpose; (b) to solicit others to perform or participate in any unlawful acts; (c) to violate any international, federal, state, or local regulations, rules, or ordinances; (d) to infringe upon or violate our intellectual property rights or the rights of others; (e) to harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability; (f) to submit false, fraudulent, or misleading information; (g) to upload or transmit viruses or any malicious code; (h) to collect or track the personal information of others; (i) to spam, phish, pharm, pretext, spider, crawl, or scrape; (j) for any obscene or disruptive purpose; or (k) to interfere with or circumvent the security features of the site or related networks. We reserve the right to terminate or restrict your access to the site or services for violating any of these prohibited uses.
SECTION 11 – DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITY
We do not guarantee, represent, or warrant that your use of our digital services will be uninterrupted, timely, completely secure, or error-free.
You expressly agree that your use of, or inability to use, the website is at your sole risk. The site and all information delivered to you through the site are (except as expressly stated by us) provided ‘as is’ and ‘as available’ for your use, without any representation, warranties, or conditions of any kind, either express or implied.
In no case shall Moline Housing Authority, our commissioners, board members, directors, officers, employees, agents, or contractors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including without limitation lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability, or otherwise, arising from your use of the site or services, or for any other claim related in any way to your use of the site, including any errors or omissions in content. Because some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, our liability shall be limited to the maximum extent permitted by applicable law.
SECTION 12 – INDEMNIFICATION
You agree to indemnify, defend, and hold harmless Moline Housing Authority, our board of commissioners, officers, directors, agents, contractors, and employees from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of your breach of these Terms of Service or your violation of any law or the rights of a third party.
SECTION 13 – SEVERABILITY
In the event that any provision of these Terms of Service is determined to be unlawful, void, or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed severed from these Terms of Service. Such determination shall not affect the validity and enforceability of any other remaining provisions.
SECTION 14 – TERMINATION
The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes. These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by ceasing use of our site.
If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we may restrict or terminate access to our site or digital services at any time without notice.
SECTION 15 – ENTIRE AGREEMENT
These Terms of Service and any policies or operating rules posted by us on this site constitute the entire agreement and understanding between you and us and govern your use of the Service, superseding any prior or contemporaneous agreements, communications, and proposals, whether oral or written, between you and us.
SECTION 16 – GOVERNING LAW
These Terms of Service and any separate agreements whereby we provide you services shall be governed by and construed in accordance with the laws of the State of Illinois and applicable federal housing regulations, without regard to conflict of law principles.
SECTION 17 – CHANGES TO TERMS OF SERVICE
The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.
You can review the most current version of the Terms of Service at any time on this page. We reserve the right, at our sole discretion, to update, change, or replace any part of these Terms of Service by posting updates and changes to our website. It is your responsibility to check our website periodically for changes. Your continued use of or access to our website following the posting of any changes constitutes acceptance of those changes.
SECTION 18 – AGREEMENT TO RECEIVE TEXT MESSAGES (SMS TERMS)
By providing your mobile telephone number to Moline Housing Authority, you agree that Moline Housing Authority and authorized agency personnel may send you periodic SMS text messages containing administrative notices, appointment reminders, housing program updates, maintenance notifications, and emergency property alerts.
Message frequency varies depending on your housing program status, maintenance scheduling, and agency notifications, typically averaging between 1 to 5 messages per month.
You may unsubscribe from text messages at any time by replying with the keyword STOP to any message you receive from us. Once you send STOP, you will receive a single confirmation message confirming that your number has been unsubscribed, and you will cease receiving text messages unless you opt back in.
For assistance or support regarding our texting service, reply with the keyword HELP to any message, or contact our office directly at 309-764-1819 or via email at info@molinehousing.com.
Moline Housing Authority does not charge you to receive text messages. However, standard message and data rates may apply depending on your wireless provider and personal mobile plan. Please consult your wireless carrier with questions about text or data charges.
You agree to notify Moline Housing Authority of any changes or updates to your mobile telephone number so that your contact records remain current. Data collected in connection with our SMS communications may include your mobile number, carrier name, and the date, time, and content of messages sent. In strict compliance with carrier guidelines, your mobile number and text messaging opt-in consent will NEVER be shared, sold, rented, or transferred to third parties or affiliates for marketing or promotional purposes.
